Unjustified requirements in grid connection specifications: AMCU recommendations

The AMCU recommended that the Ministry of Energy make the State Energy Supervision Agency’s conclusions regarding technical conditions for grid connection mandatory for the transmission system operator and regional power distribution companies. Currently, operators can disregard these conclusions without any consequences, while customers bear the costs of unreasonable requirements. The Ministry of Energy must report on the results of its review of Recommendation No. 10-rk dated September 3, 2026, within 90 days.

The State Energy Regulatory Authority may deem a technical requirement to be unjustified, but it does not monitor compliance with its own findings and lacks the authority to enforce them. The law does not provide for operators to be held liable specifically for failing to comply with these findings.

Based on the findings of the 2023–2024 inspections, operators required customers to reroute networks through protected areas without issuing reports documenting the violations. They also demanded that transformers be replaced, citing load requirements that contradicted the approved network development plans. Residential consumers were required to pay compensation for reactive power, a requirement not provided for this category.

The AMCU believes that such actions by monopolists may constitute abuse of a monopoly position. The Committee proposes establishing a procedure for operators to respond to the findings, a mechanism for oversight, and legal consequences for their unjustified disregard of these findings.

Until the changes are adopted, the current procedure remains in effect: the operator must either amend the technical specifications or file a lawsuit within 14 days.
