Task
The client approached us regarding the unlawful use of their sign by a competitor, which created risks for the brand and business stability. During additional monitoring of the state trademark register, we also discovered that the competitor had filed an application to register an identical sign.
What was done
We developed an effective strategy to protect the client's rights, the key element of which was filing an opposition against the registration of the sign. The document was prepared taking into account legal requirements, evidence of the client's use of the sign, and clearly formulated grounds for refusal of registration. The examination took the arguments provided into account, the opposition was accepted, and a decision to refuse registration of the sign was made regarding the competitor's application.
