A case we solved for:
Oksana Uskova
Task
The client approached us regarding a violation of her rights: unique authorial embroidery ornaments were reproduced by third parties and used without permission on vyshyvankas (embroidered shirts) sold through online stores. Since the client fundamentally prohibited such use of her designs, there was a need for professional legal resolution of the dispute and the termination of the unlawful actions.
What was done
We conducted a comprehensive analysis of the ornaments for similarity and signs of intellectual property rights infringement, after which we prepared a legally grounded claim demanding the cessation of copying and sale of products using the unregistered industrial design. The document clearly outlined the legal grounds, referenced the relevant provisions of the legislation, and formulated the client's demands to the infringing store, which strengthened her negotiating position and laid the groundwork for further protection of her rights. As a result, the store removed the clothing featuring the client's ornament.
