Why Registration with the State Export Control Agency Is Mandatory
The Law of Ukraine “On State Control Over International Transfers of Military and Dual-Use Goods” explicitly stipulates that Ukrainian business entities and government procurers in the defense sector that intend to carry out international transfers of goods must first register as entities authorized to conduct international transfers of goods. To do so, they must submit the documents required for a preliminary examination of the goods; based on the results of this examination, the State Export Control Authority identifies the goods, determines the conditions for their international transfers to specific countries, and issues a registration certificate along with explanations regarding the specifics of such transfers.

The law explicitly states that the entity is responsible for the preliminary identification of goods and for taking the necessary steps related to obtaining permits. This is one of the most important rules for businesses: the permitting process does not begin with filling out an application; it begins with the correct identification of the goods. It is during the review stage that it is determined whether the goods are included in the control lists, what the conditions for their transfer are, what restrictions apply to a specific country, what set of supporting documents is required, and whether the transaction in question is even possible. What Happens After You Receive a Permit: Required Reports
Obtaining a permit from the State Service for Export Control does not complete the procedure: after that, the entity is required to submit reports. For military goods, reports must be submitted on the use of the export or import permits obtained; for dual-use goods, reports must be submitted on transfers that were actually carried out, not carried out, or partially carried out, as well as on the use of the goods for the stated purposes. The procedure and deadlines for submitting such reports are determined by law and the terms of the issued permit. Failure to submit reports or late submission entails legal risks for the entity.
