About the service:
International trademark registration is an effective way to protect a brand in several countries at once. Registering an international trademark allows the owner to secure exclusive rights to the trademark outside of Ukraine and safely expand their business into international markets.
International trademark registration is relevant for brand owners who are already operating in or planning to enter foreign markets, sell goods or provide services abroad, or are developing a franchise or international partnerships. Having a registered international trademark reduces the risks of brand counterfeiting and legal disputes in various jurisdictions.
Registration steps:
The client first selects the countries or regions where they plan to protect their brand. Next, we develop the optimal registration strategy: for multiple jurisdictions, we use the Madrid System; for the European Union, we register through the European Union Intellectual Property Office (EUIPO); or we file applications directly with individual countries if a tailored approach is needed. Once the strategy is agreed upon, we take all necessary steps to prepare and file the application, and as a result, the client receives international or national registrations that provide full legal protection for the brand in the selected jurisdictions.
Registration under the Madrid Agreement:
After a trademark registration application is filed with Ukraine’s national registration authority, it is reviewed for compliance with the submitted application or the registered basic Certificate. Once the review is complete, the application is forwarded to the WIPO International Bureau for further registration.
At the international level, WIPO experts assess whether the application meets the requirements for international registration and verify the correct classification of goods and services under the International Classification of Goods and Services (ICGS). Upon successful examination, the mark is registered in the International Register and published in the official WIPO Gazette (WIPO Gazette of International Marks).
The International Bureau sends a notification to all countries listed in the international application. Within 12–18 months, each jurisdiction conducts its own examination in accordance with national law, either granting or partially granting legal protection for the mark, or refusing to grant it. Registered international marks have the same legal status as nationally registered marks.
Upon completion of the procedure, the owner receives a certificate of international registration for their mark from each country.
Registration through the European Patent Office:
Registering a trademark through the European Union Intellectual Property Office (EUIPO) allows you to protect your brand immediately in all European Union countries. When filing an application, we ensure it is properly prepared and complies with EUIPO requirements, including the classification of goods and services. After submission, the application undergoes an examination, a check for conflicts with previously registered trademarks, and an assessment of compliance with all formal requirements.
Upon successful examination, the trademark is registered in the European Trademark Register and gains full legal protection in all EU countries. The owner receives a registration certificate and official confirmation of the brand’s protection.
Registration under the national procedure:
To register a trademark at the national level, we work through our trusted partners—patent attorneys in the respective countries. They oversee the entire process, from preparing and filing the application to obtaining registration, ensuring compliance with all requirements of national legislation.
We coordinate all activities and monitor the process at every stage to ensure that the client receives reliable legal protection for their trademark in the selected countries and an official certificate confirming registration.
