Occupational Safety Declaration or Declaration of Compliance of the Material and Technical Base with Occupational Safety Legislation — is an official, mandatory document confirming that the employer has established safe working conditions, provided staff with protective equipment and training, and ensured compliance with occupational safety requirements when performing high-risk work or operating high-risk equipment.
The document is submitted in accordance with Resolution No. 1107 of the Cabinet of Ministers of Ukraine dated October 26, 2011, which regulates the procedure for issuing permits and registering declarations.
Important! In accordance with Resolution of the Cabinet of Ministers of Ukraine No. 77 dated February 3, 2021, No. 77 “On Approval of the List of High-Risk Machines, Mechanisms, and Equipment and Amendments to Certain Resolutions of the Cabinet of Ministers of Ukraine,” the lists of high-risk equipment and work have been significantly expanded. They have been divided into Groups A and B.

Who is required to file a tax return
Every employer who uses hired labor when performing high-risk work or operating high-risk equipment must file an occupational safety declaration. It does not matter whether the employer is a legal entity or a sole proprietor—the obligation to submit a declaration regarding the material and technical base applies in both cases if employees are engaged under an employment agreement or contract.
The occupational safety declaration must be submitted and registered no later than five days before the start of work or the use of equipment. Failure to meet these deadlines entails liability under Article 164 of the Code of Ukraine on Administrative Offenses: a fine ranging from 1,000 to 2,000 non-taxable minimum incomes, with the possible confiscation of products, raw materials, equipment, or funds obtained as a result of unlawful activities.
How to File an Occupational Safety and Health Declaration
