What Is Protected as an Industrial Design
An industrial design is the appearance of a product, specifically:
shape and configuration;
lines, contours, and proportions;

Key point: It is not the idea that is protected, but rather the visual design as specified in the application.
Conditions for Legal Protection
For international registration, a design must meet two basic criteria:
novelty—an identical design has not been made public anywhere in the world;
individual character—the overall impression of the design differs from known designs.
Risk: Any publication prior to filing the application (catalogs, websites, Instagram, marketplaces) may compromise novelty.

National applications in individual countries

- faster protection in individual jurisdictions.
Right of Priority
International priority allows you to file an application abroad within 6 months of the date of the first filing in Ukraine while retaining the priority date.
This is critical for businesses that engage in active marketing and public announcements.
What You Need to Submit an Application
To begin the process, you will need:
- an image of the design (photo or graphic);
- information about the applicant and the designer;
- selection of countries;
Term of Validity of Rights
International design protection—up to 25 years
(provided that the registration is renewed in a timely manner in accordance with the laws of the specific country).
